Know Your Rights
Read the "Guide for Employees" at the link on this
website (see below). Note that this document is meant to provide
an overview of regulations for employees asked to take a polygraph
examination. It is not "legal advice" and is not meant
to be used as a substitute for consulting an attorney. Any employee
asked to take a polygraph examination has a right to consult with
counsel and should do so. Each case is different, and legal advice
needs to be responsive to the particular facts of any case.
User Beware
SPSE is making this form available as a means for LLNL employees
to assert their rights under the law and under the Federal regulations
when they are asked to take a polygraph examination. Anyone asked
to take DOE polygraph examination is welcome to obtain this form
and use it. But be aware that this is a suggested form only. It
is not a substitute for legal advice, and SPSE cannot be responsible
if DOE reacts adversely to using the form.
It is a violation of law for DOE to retaliate against an employee who asserts his/her rights under the law and under these regulations. It is not possible, however, to predict what the reaction might be in specific instances if an employee presents the form to a polygraph examiner. Just because it is illegal for DOE to take action against you for exercising your rights does not mean that a polygraph examiner or others in DOE will not do so. So we offer this form to employees with this "user beware" caution. We suggest that if you want to use it, you consult your attorney before doing so.
SPSE members are urged to consult with a representative from SPSE prior to taking a polygraph examination. SPSE supports and advises its members on their employee rights; members who would like further clarification on their rights under the polygraph rules may contact the SPSE Office to schedule a time for a briefing.
